Incomplete inputs, delayed approvals, third-party restrictions or changes in scope can affect timing and outcomes. Any resulting changes to fees or deliverables must follow the agreed change process.
Marketing outcomes and third-party platforms
Marketing performance depends on factors including competition, budgets, implementation, audience behaviour and decisions made by search engines, advertising platforms, social networks and AI services. EvenSurge does not control those platforms or their policies.
Unless an express commitment is included in an accepted written agreement, we do not guarantee a particular ranking, traffic level, lead volume, revenue figure, advertising return, AI citation or date by which a result will occur.

Restricting access

A Website access restriction does not, by itself, cancel a separate service agreement. Termination of paid services follows the terms of that agreement and applicable law.
Governing law and disputes
These Website Terms are governed by the laws of India, and of the state of West Bengal, subject to any mandatory protections that apply to you.

Subject to mandatory law, the competent courts in Kolkata, West Bengal, including the High Court at Calcutta, have jurisdiction over disputes concerning these Website Terms. A different dispute process expressly agreed for paid services applies to that engagement.
Changes and general provisions
We may revise these Terms for future Website use and will display the updated date. Where a material change requires notice or renewed acceptance, we will provide or request it as required. Changes to these Website Terms do not retrospectively amend an accepted service agreement.
If a provision is unenforceable, the remaining provisions continue to apply to the extent legally possible. A delay in exercising a right does not waive that right. These Terms do not create a partnership, employment or agency relationship between a Website visitor and EvenSurge.
